1. Acceptance of Terms
By downloading, installing, or using PreVault ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.
2. Description of Service
PreVault is a desktop backup application for Windows that allows you to create incremental backups of your files to local storage or cloud storage services (Google Drive, OneDrive, Dropbox). The Software is provided with both free and paid tiers.
3. License Grant
Free Tier
PreVault is free to download and use for personal and educational purposes with the core feature set. No license key is required for the free tier. Commercial use requires a paid license.
Paid Tier (Annual / Lifetime)
Premium features require a valid license key. Licenses are granted as a non-exclusive, non-transferable right to use the Software on the number of devices specified by your license plan.
- Annual licenses are valid for 12 months from the date of purchase and may be renewed.
- Lifetime licenses grant perpetual access to all features available at the time of purchase. Access to future major version upgrades may require a separate license.
4. Accounts & Registration
Certain features may require you to provide an email address and create an account. You are responsible for maintaining the confidentiality of your account credentials and license key. You agree to provide accurate information and to notify us promptly of any unauthorized use.
5. Payment & Refunds
- Payments are processed securely through Stripe. We do not store your credit card information.
- All prices are displayed in the currency shown at checkout.
- Refund requests may be submitted within 14 days of purchase if the Software does not function as described. Contact us to request a refund.
6. Cloud Storage Integration
When you connect a cloud storage service, you authorize PreVault to write backup files to your cloud storage account. You acknowledge that:
- PreVault accesses your cloud storage solely to perform backups.
- You retain full ownership of your files and backup data.
- Cloud storage is subject to the respective provider's terms of service and storage limits.
- PreVault is not responsible for data loss caused by cloud provider outages, account suspensions, or changes to third-party APIs.
7. Telemetry & Analytics
PreVault collects anonymous telemetry data to improve the Software. This includes app version, OS version, anonymous device identifiers, and usage events. No personal files, file names, or file contents are collected. See our Privacy Policy for details.
8. Acceptable Use
You agree not to:
- Reverse-engineer, decompile, or disassemble the Software.
- Share, distribute, or sublicense your license key to others.
- Use the Software in any way that violates applicable laws or regulations.
- Attempt to circumvent license validation or security measures.
9. Intellectual Property
PreVault is proprietary software. All source code, original content, features, and functionality are owned by PreVault and are protected by applicable copyright and trademark laws. The Software is not open source and no rights to the source code are granted under these Terms. Your backup data remains your property at all times.
10. Disclaimer of Warranties
The Software is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
PreVault does not warrant that:
- The Software will be uninterrupted, error-free, or secure.
- Backups will always complete successfully.
- Data loss will never occur.
You are solely responsible for maintaining additional copies of your important data. PreVault is one layer of a sound backup strategy, not a guarantee against data loss.
11. Limitation of Liability
To the maximum extent permitted by law, PreVault and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of your use of the Software.
Our total liability for any claim arising from these Terms or use of the Software shall not exceed the amount you paid for your license in the 12 months preceding the claim.
12. License Revocation
We reserve the right to revoke a license key if we reasonably determine that the Terms have been violated, including but not limited to key sharing, unauthorized redistribution, or abuse of the service.
13. Modifications
We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of the Software after changes constitutes acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to conflict of law provisions.
